Court to Reconsider Decision That Allowed Trump to Deploy Military Forces to Portland
The ninth circuit court has upheld a prohibition on deploying state troops in Portland, Oregon, following a recent legal decision.
Judicial Panel Agrees to Reconsider Legal Matter
The federal appeals court ruled on Tuesday that it would reexamine the case concerning the executive power with an larger panel of 11 judges. The judicial body also vacated a previous ruling from a smaller judicial group that had supported the federal government.
Legal Saga Over Troop Deployment
This legal directive represents the latest development in a protracted court case over whether the former president has the authority and justification to deploy state military units in the city. Approximately two hundred troops have been in limbo since late September when the deployment effort was started in response to months of protests.
Conflicting Arguments
The administration has argued that government employees at the immigration center in south Portland were under attack, while local authorities maintain that local officers have control of the circumstances.
Contrary to descriptions of Portland as a conflict zone, locals have been posting videos of lush hiking trails and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.
Recent Legal Actions
The Tuesday ruling came after a US district judge in Portland issued two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the use of any military personnel in the state, after attempts to circumvent the first order by calling up troops from California.
On Monday, the ninth circuit panel had put the first ruling on hold – allowing control of 200 Oregon national guard – but the second ruling remained in place, blocking the physical sending of the forces.

The Tuesday decision means the matter will be heard by the full court – with both rulings under review together – by a panel of eleven justices.
“This ruling demonstrates that the truth matters and that the judicial system are working to hold this administration accountable. The constitution restricts the president’s power, and local populations cannot be treated as a training ground for expansive government power,” stated the state attorney general in a statement.
“The judicial body is sending a clear message: the president cannot dispatch the armed forces into US cities without cause. We will continue protecting Oregon’s laws, principles, and sovereignty as this legal proceeding moves forward and our legal battle continues in the judicial system.”
